ACT – Estates – New publication

We are delighted to announce a new publication by our ACT author, Doug Dawson, being a Guide for Probate and Letters of Administration (ACT).

The guide features detailed commentary, a matter plan and all necessary forms and precedents for obtaining a grant, getting in the assets and making the distribution.

The practical nature of this publication allows the practitioner to:

Wills – Testamentary discretionary trusts

The commentary on testamentary discretionary trusts in our Wills publications now has a more in depth discussion of:

  • the benefits of testamentary discretionary trusts;
  • when a testamentary discretionary trust is appropriate;
  • family trust elections.

There are several By Lawyers precedent wills which create testamentary discretionary trusts for individuals and spouses, as well as a library of testamentary discretionary trust clauses. These precedents can be used to establish a single testamentary discretionary trust for all assets and beneficiaries of the estate, or multiple testamentary discretionary trusts for specific beneficiaries. They can also be used to establish additional testamentary discretionary trusts to provide protection for specific assets such as quarantining a family business or to allow for the particular needs of an individual beneficiary due to say drug addiction.

QLD – Online transmission applications – Updated forms, new Trust Details form and updated commentaries

From May 2018 transfers recording a transferee  – that is, the executor – as trustee can be lodged electronically. To do this only details of the trust will be required – that is, as executor pursuant to grant of probate.

For consistency in paper the Titles Registry introduced the Trust Details form, on which the basis of the trustee transfer can be noted. Transmission applications that are supported by a grant from a foreign jurisdiction that is eligible for re-seal in Queensland under the British Probates Act 1898 (a Queensland recognised grant) that have not been resealed in Queensland are now made on a form 5.

While a form 1 Transfer is available through PEXA and eLodgement, transmission application forms 5 and 5A can only be lodged through eLodgement. See Electronic lodgement of title transactions (eLodgement) for details of what forms can be lodged and how to use eLodgement.

Transitional provisions for forms 5 and 5A are in place until 30 September.

Forms 5 and 5A have been updated to the latest version. The new Trust Details form has been added to the matter plan. Also our Probate and Letters of Administration commentaries have been updated to reflect these changes.

ACT – Powers of Attorney, Appointment of Guardians and Managers and Advance Care Planning – New publication

This useful publication allows the practitioner to take instructions via a comprehensive and methodical instruction sheet, then confidently advise upon and prepare appropriate powers of attorney, guardianship and/or management applications and advance care plans.

ACT – Wills – Complete publication including Wills commentary and new precedents

We have had a Wills publication in the ACT for some time, but up until now it has been just the basics.

Our Wills ACT publication now has a comprehensive commentary to accompany the matter plan, with custom ACT precedents such as retainer instructions.

Wills retainer instructions – All states – Burial, cremation and medical research details

Retainer instructions in all states – for individuals and couples – have been enhanced with the addition of burial, cremation and medical research client details.

For instance, does the client wish to:

  • detail funeral service arrangements;
  • detail wishes regarding burial or cremation of their remains; or
  • make provision for ongoing cemetery or crematorium fees?

VIC – Powers and Advance Care Directives – Precedent coding – New table types

The Medical Treatment Planning and Decisions Act 2016 came into effect on 12 March 2018 and our Powers and Advance Care Directive publication was updated accordingly.

New precedents reflecting those changes were added:

  • Advance care directive and corresponding revocation form;
  • Appointment of medical treatment decision maker and corresponding resignation and revocation forms;
  • Appointment of support person and corresponding resignation and revocation forms.

These precedents have now been coded with the new table types – Medical Decision Maker and Support Person. You will need to add these table types to existing matters for your forms to populate.

Estate planning – An exciting opportunity for small law firms – By Brad Watts

The Medical Treatment Planning and Decisions Act 2016 commenced 12 March 2018. It gives statutory recognition to advance care directives and simplifies and contemporises laws relating to medical treatment decision making for people without decision making capacity.
